These general terms and conditions of sale are concluded between EI Louise Ginioux, registered under SIRET number 93139064500014, hereinafter referred to as the “seller”, and any natural or legal person wishing to make a purchase via the website lvangardia.fr, hereinafter referred to as the “buyer”.

The acquisition of a good via the vangardia.frr site implies unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by the seller.

The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the products offered

The descriptions and photographs of the items sold on the Vangardia website are as accurate and faithful to reality as possible.

However, as these are handmade jewels, some lengths indicated may have slight variations. Similarly, some colors and shapes may have irregularities inherent to their natural character or to this artisanal manufacturing method.

The customer thus acknowledges that the photographs and descriptions illustrating the products offered for sale on the site are indicative and not contractual and cannot engage the liability of the seller in the event of error, omission or modification.

Vangardia guarantees its jewelry for life against manufacturing defects, provided that the jewelry is used properly (do not shower or swim with it) and maintained according to the recommendations provided. If a piece of jewelry is poorly maintained or misused, the warranty will not cover the damage.

During this warranty, at our discretion and depending on the availability of parts, the jewel may be repaired.

The warranty does not cover jewelry that has been subject to improper use or treatment, failure to follow care instructions, external intervention resulting in a modification or alteration of the initial model, or an accident.

Unless there is a proven manufacturing defect, only the shipping costs will be borne by the customer.

Outside of the warranty conditions, Vangardia offers a re-gilding service for its entire range of jewelry (free for one year from the date of purchase of the jewelry). This service, on request, is charged. The price is issued according to the surface of the jewelry to be re-gilded. The re-gilding is carried out after payment of the fees. We reserve the right to refuse jewelry showing signs of wear that are too deep other than a loss of gilding.

The repair and regilding time is 6 to 8 weeks from the date of receipt of the jewel in our workshop. However, the time may change depending on the activity of the workshop.

The prices indicated on the vangardia.fr website are inclusive of tax in euros. For shipments in France, the prices indicated on the website include shipping costs. For shipments outside France, shipments will be made via Colissimo International at a price of 10 euros. For any order over 150€, shipping costs are free.

The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when the order is registered.

The information provided by the buyer when placing the order is binding on the buyer.

In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

Orders are only final when they have been confirmed by payment of the price by the buyer.

Any package that cannot be delivered and returned to the sender will be re-delivered at the customer's expense.

Once the order has been validated, the recipient agrees to pay customs fees and all taxes relating to receipt of the package.

In the event of refusal to pay customs duties by the recipient, the sender will not be able to ensure the repatriation of the package with a view to a refund of the order.

En application de l'article du code L.121-20-12 du code de la consommation, l'acheteur dispose d'un délai de quatorze jours pour retourner à ses frais les articles ne lui convenant pas, contre remboursement. Ce délai court à compter du jour de réception de la commande. Tout retour devra être signalé au préalable par mail à : contact@vangardia.fr. Ce droit de rétractation s'exerce sans pénalité, à l'exception des frais d'envoi et de retour. 

Le ou les articles retournés doivent être à l'état neuf, ne pas avoir été portés ni utilisés ou ayant fait l'objet d'un usage quelconque et dans leur emballage d'origine. Dans le cas contraire, les produits ne seront ni remboursés, ni repris.

Delivery

The shipment will be made:

- in France, by Colissimo (6 to 7 working days)

- Internationally, by Colissimo International (10 working days)

- He also has the possibility of collecting his order free of charge at 16 bis rue de l'abbé Grégoire, Issy-les-Moulineaux, by appointment.

The delivery times indicated on the website and during order confirmation are for information purposes only and correspond to the average processing and delivery times for packages. These delivery times are not effective for pre-ordered items. Pre-ordered items will be delivered within a maximum of 8 weeks. These announced delivery times do not take into account disruptions encountered by carriers.

Any reasonable delay in the shipment of the products may not give rise to the award of damages or cancellation of the order for the benefit of the buyer.

In the event that the package is damaged upon delivery, the customer will check the condition of the items with the carrier.

All elements of the vangardia.fr site are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site.

The seller will archive the purchase orders on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The seller's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the seller and the buyer.
